28 / OGRA MILESTONES CONFERENCE 2017 Late last fall, the Government announced that it would be introduced legislation that would target unsafe driving in community safety zones. Bill 65 Safer School Zones Act, 2016 gives municipalities the ability to enhance safety measures in community safety zones and school zones. is is the third time in recent years that similar legislation has been introduced. In 2015 Taras Natyshak (NDP), MPP Essex, introduced Bill 99, An Act to Amend the Highway Traffic Act with Respect to Safety Cameras. Prior to this, legislation was introduced by David Caplan in 2011. In both of these earlier instances the Bills were Private Members Bills. When those earlier Bills were introduced the Minister of Transportation of the day indicated that there was no desire on the part of the government to amend the Highway Traffic Act to permit municipalities to enact these measures. e prescriptions in Bill 65 would authorize municipalities to: • Adopt automated speed enforcement (ASE) technology on municipal roads, which takes pictures of speeders' licence plates and is already used in many parts of North America and Europe, and for community safety zones and school zones; • Create zones with reduced speed limits to decrease the severity of pedestrian-vehicle collisions in urban areas; and • Use a streamlined process for participating in Ontario's Red Light Camera program without the need for lengthy regulatory approval. e Bill also amends the Highway Traffic Act to permit municipalities to designate areas through by-law where speed limits that are lowered below 50 kilometres per hour. In a bout of linguistic flourish, Part XIV of the HTA .1 (Photo- Radar System Evidence) of the Act is repealed and replaced by a new Part XIV.1 (Automated Speed Enforcement). is would allow municipalities to authorize the use of automated speed enforcement systems in community safety zones and school zones.
